The Rex Hotel Conditions of Entry
General
Your entry to The Rex Hotel (including the car park) located at 145 Bay St, Port Melbourne, VIC 3207 ("The Rex Hotel") is subject to these terms and conditions of entry ("Conditions").
It is your responsibility to inform yourself of these Conditions. By entering The Rex Hotel or possessing a ticket or booking for entry to The Rex Hotel, you are deemed to have accepted and understood these Conditions and any accompanying risks, obligations and responsibilities.
Conditions of Entry
The Rex Hotel reserves the right to refuse entry to or remove any person from the Venue.
Persons under 18 years of age cannot enter a gaming machine area. If you bring minors to the Venue, you are responsible for the care, conduct and supervision of those minors at all times and must keep those minors within your sight at all times.
The Rex Hotel prohibits certain goods from being brought into the Venue. A current list of these goods is listed in the attachment headed "Prohibited Goods". The Rex Hotel reserves the right to add to or change this list at any time.
You must immediately comply with all laws and any reasonable directions given to you by The Rex Hotel staff, as well as MVRC, and its representatives, including any emergency evacuation or procedure or any other occupational health and safety requirement. The Rex Hotel may search you and any goods in your possession or control to determine whether you have complied with clause 5.
You are responsible for your own property (including, without limitation, any motor vehicle) and The Rex Hotel will not be liable for loss, damage to or theft of any property brought to the Venue.
It is unlawful for minors under 18 years of age to purchase alcohol or to gamble, and minors are prohibited at all times from doing so at the Venue.
RESPONSIBLE GAMBLING
The Rex Hotel is committed to the responsible conduct of gambling activities and compliance with all applicable gaming laws and regulations.
You acknowledge and agree that:
a) gambling should be undertaken for entertainment purposes only and within your personal financial means;
b) The Rex Hotel may take any action required under applicable gambling legislation, regulations, codes of conduct or regulatory requirements, including monitoring gaming activity and providing responsible gambling information and assistance;
c) The Rex Hotel reserves the right to refuse service, restrict access to gaming facilities, remove a person from gaming areas, or take any other action required by law or considered reasonably necessary to support responsible gambling practices;
d) if you are subject to a self-exclusion order, venue exclusion order, regulator-imposed exclusion or any other lawful restriction relating to gambling activities, you must not enter or remain within any gaming machine area of the Venue; and
The Rex Hotel may share information with relevant regulatory authorities or approved support services where required or authorised by law.
On Selling
You are not permitted to sell or on-sell your tickets to any The Rex Hotel events (by any means) without the prior written approval of The Rex Hotel, including but not limited to use for advertising, promotion or other commercial purposes, such as giveaways, trade promotions or competitions.
Cancellation, Refund Policy & Conditions
If an Event is cancelled before the scheduled commencement time, it may be rescheduled, and you will be offered an admission ticket to the rescheduled Event or a refund of the cost of your admission ticket.
Liability and Indemnity
There are inherent risks associated with attending the Venue, including risks of personal injury, illness, death, property damage or loss, and risks associated with the conduct of other patrons and the consumption of alcohol.
To the fullest extent permitted by law, The Rex Hotel does not warrant weather conditions, the availability of shelter or the comfort of patrons attending the Venue.
Under applicable consumer protection legislation, including the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law, certain guarantees, rights and remedies cannot be excluded, restricted or modified.
You indemnify and agree to keep indemnified The Rex Hotel, MVRC and their respective officers, employees, contractors and agents against any claim, loss, liability, damage, cost or expense arising from your unlawful acts, omissions or breach of these Conditions, except to the extent caused or contributed to by the negligence, wilful misconduct or breach of law by The Rex Hotel or MVRC.
The Rex Hotel's liability to you is limited to loss or damage directly caused by its negligent acts or omissions or any breach of non-excludable rights under applicable law.
Subject to applicable law, The Rex Hotel will not be liable for indirect, consequential, special or economic loss arising from the cancellation, postponement or interruption of any Event.
Use of Images and Material Created
You acknowledge that you may be filmed, photographed, televised or otherwise recorded while at the Venue by The Rex Hotel or its authorised representatives.
The Rex Hotel owns, or is entitled to use, all rights in such recordings, photographs and materials, including intellectual property rights, and may use, reproduce, publish, broadcast, communicate or licence such materials without compensation to you.
Where The Rex Hotel reasonably suspects that images are being taken for non-personal use, the person taking the images may be removed from the Venue.
Breach of Condition
The Rex Hotel may refuse entry to remove or exclude a person from the Venue where it reasonably believes that person:
a) is in breach of these Conditions;
b) is intoxicated or affected by drugs;
c) is engaging in unlawful, offensive, threatening or disruptive behaviour;
d) poses a risk to the safety, security or enjoyment of others; or
e) is otherwise required to leave under applicable law.
Privacy
The Rex Hotel collects, uses, stores and discloses personal information in accordance with the MVRC Privacy Policy. (available on the MVRC website https://www.thevalley.com.au/privacy-policy).
The Rex Hotel may share your personal information with third parties such as its ticketing agency and other companies engaged to carry out functions and activities on MVRC's behalf, including direct marketing, companies MVRC engages to operate rewards and loyalty programs or otherwise in accordance with the MVRC's Privacy Policy. Your information is not generally disclosed overseas. MVRC's Privacy Policy contains information about how you may access and request correction of your personal information and provides information about how a complaint will be dealt with by MVRC. If you do not wish to receive promotional material from MVRC, MVRC's sponsors or third parties, you must advise MVRC by email or telephone or via the specific opt-out procedures in the relevant communication.
Medical Treatment
If you suffer any injury or illness while at the Venue, you authorise The Rex Hotel to arrange or facilitate first aid, medical treatment, ambulance transport or evacuation where reasonably necessary.
You acknowledge that any medical costs incurred may be your responsibility.
Unauthorised Promotion
You must not, without the written authorisation of The Rex Hotel, represent in any way, including by advertising material, statement or inference, that:
a) you are a sponsor or affiliate of, or in any other way connected with, the Event; and
b) The Rex Hotel has approved of, or supports in any other way, any goods or services offered for sale or supply by you.
If The Rex Hotel reasonably believes that any advertising material that has been brought into or is displayed in or at the Venue makes a representation in contravention of this clause, The Rex Hotel or its authorised representatives may:
a) remove, obliterate, conceal or dispose of the advertising material; or
b) direct a person whom The Rex Hotel reasonably believes is responsible for bringing in or displaying the advertising material to do any of the things specified in subclause (a).
General
You acknowledge and agree that any provision of these Conditions that is invalid, illegal or unenforceable will be severed and the remaining provisions will continue in full force and effect.
These Conditions are governed by the laws of Victoria, Australia, and each party submits to the exclusive jurisdiction of the courts of Victoria.
SCHEDULE 1 — Prohibited Goods
liquor or any alcoholic beverages
glass objects
cans
opened beverage containers or those with the manufacturer's seal broken
drink coolers, ice boxes or eskies
firearms, knives or any other implement that may be used as a weapon or used in a way which affects the safety of those in the venue, damages property, or interferes with the comfort of patrons at The Rex Hotel.
a "dangerous article", "prohibited weapon" or "controlled weapon" each within the meaning of those terms as defined in the Control of Weapons Act 1990 (Vic)
flares, distress signals including pyrotechnic devices, rockets and smoke generators
or other explosives or flammable good or equipment
laser lights or laser pointers
drones or similar unmanned aerial vehicles or surveillance devices
musical instruments
whistles and loud hailers, horns, bugles, vuvuzelas
a flag or banner larger than one metre by one metre or with a handle longer than one metre
rollerblades, skateboards, hoverboards or scooters
torn up paper, confetti, rice or streamers
sporting goods such as footballs, soccer balls or tennis balls
folding or camp chairs, lounges, benches, stools or tables
animals excluding animal/s used for your assistance if you are blind, deaf or otherwise have a disability
dangerous goods as defined in the Dangerous Goods Act 1985 (Vic)
except if authorised by The Rex Hotel, any item you intend (or such quantities of the item from which The Rex Hotel can reasonably infer that you intend) to distribute, sell, offer or expose for sale
any item bearing any image, slogan or text that is indecent, discriminatory, obscene, insulting or threatening, as determined by The Rex Hotel in its sole discretion
except if authorised by The Rex Hotel, public address systems, electronic equipment, broadcast equipment or similar device that may interfere with the broadcast equipment or similar devices being used by The Rex Hotel
any item the possession of which does not have an ordinary and reasonable use by a person within the Venue
any other objects, device or substance that may be used to deface or damage any part of the venue or which, in the opinion of The Rex Hotel, has the potential to cause injury, offence, embarrassment or disturbance to any other person
SCHEDULE 2 — Prohibited Behaviour, Conduct & Activities
You must not, in or around the Venue engage in the following prohibited behaviour, conduct and activities.
Litter
Throw or attempt to throw objects
Hinder or obstruct, or attempt to hinder or obstruct
Advertise, offer or expose for sale any goods or articles or bring any goods, articles, utensils or appliances which you intend to advertise, offer or expose for sale
Possess, use or attempt to use a prohibited item (see Prohibited Goods)
Except if authorised by The Rex Hotel, provide any services for fee, gain or reward, collect or attempt to collect money, distribute advertising matter, play musical instruments, use any audio or broadcasting equipment or a camera for commercial purposes
Post, stick or place or attempt to post, stick or place any printed material on any part of the Venue without the prior written consent of The Rex Hotel
Block any thoroughfare including, without limitation, any stairs, steps, aisle, gangway, overpass, underpass, bridge, passage, entry or exit
Climb any tree, flagpole or other fixture
Set off any firework
Fail to comply with a reasonable request or direction given by The Rex Hotel or its authorised representatives for the purpose of securing good order and management and enjoyment of the Venue
Misuse, deface, damage, remove from the Venue or tamper with or attempt to misuse, deface, damage, remove from the Venue nor tamper with any building, animal, plant, structure, signage, equipment or thing
Inflate, or cause to inflate, any item or good
Systematically collect or pick up used betting tickets discarded by others (other than as part of the authorised rubbish collection)
Use indecent or obscene language or threatening or insulting words, or otherwise behave in a provocative, disorderly, threatening, abusive, riotous, unsafe, indecent or insulting manner or act in a manner detrimental to the enjoyment of other patrons.
Behave in any manner that unduly interferes with the amenity of the Venue or the enjoyment of the Venue by patrons, or causes serious alarm or affront to a person by disorderly conduct
Use a loudspeaker, public address system or other broadcast device
Operate or use any electronic device or audio equipment to broadcast sound or video at a volume likely to cause a nuisance to another person or to unduly interfere with the amenity of the Venue
Busk
Interfere with, obstruct or hinder any employees, agents or contractors of The Rex Hotel in the exercise of his or her powers, functions or duties
Disrupt or attempt to disrupt, or behave in a manner that may disrupt or interrupt the Venue, any horse race or activity relating to the Event or a particular horse race
Deliberately obstruct the view of any other person seated in a seat in the immediate vicinity
Conduct entertainment without the prior written consent of The Rex Hotel
Engage or participate in any conduct, protest or demonstration that may disturb or offend others, or which may disrupt or hinder proceedings
Use photographic, video or audio recording equipment in areas where such use is prohibited
Make, record or transmit or attempt to make, record or transmit any form of still or moving film or sound recording or digital or analogue image of any part of the Venue or a horse race other than for the private enjoyment of the person making, recording or transmitting it, without the written authorisation of The Rex Hotel
Communicate information relating to estimated or actual betting odds by any means to any person not at the Venue.
Conduct surveys or opinion polls, solicit money, donations or subscriptions from patrons, without the prior written consent of The Rex Hotel
Smoke in areas nominated by The Rex Hotel as non-smoking
Enter the non-public access areas of the Venue
Obstruct a person in the performance of the person's work or duties in relation to the Venue
The Rex Hotel adopts a responsible service of alcohol policy. A person under the age of 18 years must not attempt to obtain admission onto the licensed areas of the Venue unless accompanied by a parent or guardian. You must not supply underage patrons with alcohol.
Marketing & Membership Terms and Conditions
1) Introduction
a) These Terms and Conditions ("T&Cs") apply to all Members of The Moonee Valley Racing Club ("The Club") and individuals who opt-in to receive marketing communications from The Club or Moonee Valley Racing Club (us, we, our). By becoming a member, attending the venue, using your membership or accessing any membership benefits, or subscribing to our marketing communications, you agree to abide by these T&Cs and the privacy consents referred to in these T&Cs. A "Member" is a member of The Club membership program.
b) You acknowledge that you have read and understood these T&Cs.
c) A copy of these T&Cs may be viewed on The Club website or obtained from The Club.
2) Membership Terms
Eligibility
You must be at least 18 years old to be a member or to subscribe to our marketing communications.
Membership Benefits
Members enjoy access to exclusive events, discounts, and promotions as outlined in their membership package.
Benefits may vary based on the membership tier and are subject to availability.
Use of Membership
Memberships and associated benefits are non-transferable and may only be used by the registered Member.
Misuse of membership benefits may result in the suspension or termination of your membership or marketing communications subscription at the discretion of The Club.
Changes to Membership
The Club reserves the right to modify the membership program, marketing communications program, or any benefits associated with membership or marketing communications subscriptions. The Club will provide at least 30 days' notice of any material changes via The Club website.
By signing up to MVRC Social Membership, you acknowledge and agree that:
a) Purpose and access: MVRC Social Membership is intended to support streamlined entry to MVRC club-licensed venues by recognising you as a member for sign-in and compliance purposes, so you may not be required to complete repeated visitor sign-in processes each time you attend those venues.
b) Not racecourse membership: MVRC Social Membership does not provide access to Members’ facilities at the racecourse and does not include racecourse membership benefits, race day entitlements, or access rights that apply to MVRC racecourse members.
c) No voting / governance rights: MVRC Social Members are not entitled to voting rights or any governance participation in MVRC (including voting at meetings or standing for any office) and are not part of the governance membership classes.
d) Separate register: MVRC Social Members may be recorded in a separate members register and MVRC may use your details to administer the membership and to meet its regulatory and compliance obligations.
e) Benefits limitations: Any Social Membership benefits (if offered) will be hospitality, and food and beverage focused and will not include gaming inducements. Benefits may vary, be withdrawn, or change from time to time.
f) Venue rules still apply: MVRC Social Membership does not override venue conditions of entry, responsible service of alcohol requirements, or any direction from MVRC venue staff. MVRC reserves the right to refuse entry or remove a person from a venue in accordance with applicable laws and venue conditions.
g) Compliance: MVRC Social Membership is administered to support compliance with relevant obligations (including under liquor and gambling laws and regulatory requirements). MVRC may suspend or cancel a Social Membership where required for compliance or where misuse is suspected.
Responsible Gambling
MVRC and The Rex Hotel are committed to the responsible service of gambling and compliance with all applicable gambling laws, regulations and regulatory requirements.
By becoming a Member, you acknowledge and agree that:
a) membership does not entitle you to participate in gambling activities and does not provide any preferential access to gaming facilities;
b) any benefits associated with membership will not constitute prohibited gambling inducements and will be administered in accordance with applicable Victorian gambling laws and regulations;
c) MVRC and The Rex Hotel may suspend, restrict or cancel a membership where required to comply with responsible gambling obligations, self-exclusion arrangements, venue exclusion orders, regulatory directions or other legal requirements;
d) Members are encouraged to gamble responsibly and seek assistance if gambling is causing financial, personal or social harm; and
e) MVRC and The Rex Hotel may provide information regarding responsible gambling services and support organisations, including gambling help services available in Victoria.
Member Information
Members must promptly notify The Club of any changes to their contact details. The Club is not responsible for any loss arising from a Member's failure to maintain accurate and up-to-date contact information.

3) Marketing Communications
Opting In
By agreeing to be a Member or subscribing to our marketing communications, you agree to receive promotional content, newsletters, event updates, and special offers via email, SMS, or other channels.
Opting Out
You may unsubscribe from marketing communications at any time by clicking the “unsubscribe” link in our emails or contacting us directly at (03) 9370 0411.
Opting out of marketing communications does not affect your membership status or access to essential service updates.
Frequency of Communications
Marketing communications will be sent periodically. We strive to ensure content is relevant and not excessive.
4) Promotions
From time to time, you may be invited to participate in promotional activities, including games of skill and games of chance, at The Club or through your membership of The Club. Participation in these promotional activities is optional and subject to the terms and conditions of the promotion, which will prevail over these T&Cs where there is inconsistency, only in relation to the promotional activity.
5) Data Collection and Privacy
Personal Information
We collect personal information, including name, contact details, and preferences, for the purpose of providing services to Members and sending marketing communications.
You acknowledge that the Club and Moonee Valley Racing Club (together The Clubs) may use or disclose your personal information for the purposes of providing you with member services or promotional material or otherwise in accordance with The Club's Privacy Policy.
By joining as a Member of The Club or subscribing and agreeing to receive marketing communications, you consent to The Clubs, their related entities and business partners (including companies engaged by The Clubs to carry out functions and activities on their behalf including direct marketing; The Clubs' professional advisers, including accountants, auditors and lawyers and The Clubs' insurers) collecting and using your data and personal information for the purpose of sending direct marketing messages with respect to programs, products, services and promotions available through any of them and in accordance with our Privacy Policy found at www.rexhotel.com.au/privacy-policy. Your information is not generally disclosed to anyone outside Australia.
You acknowledge that your membership application or marketing subscription may be rejected if the requested information is not provided. If you do not wish to receive promotional material from The Clubs' sponsors and third parties, you must advise The Club in writing or via the opt-out procedures provided in the relevant communication.

Data Sharing
Personal data will not be shared with third parties except as required by law or in accordance with these T&Cs.
Data Retention
We retain your personal data only for as long as necessary to provide services and comply with legal obligations.
6) Termination and suspension of Membership or Marketing Subscription
Termination by Member
Members may cancel their membership by providing written notice.
Marketing subscribers, including Members, can opt-out at any time via the methods outlined in Section 2).
Termination by The MVRC
The MVRC may terminate your membership or marketing subscription if:
i) you are in breach of these T&Cs or the MVRC’s Club Rules, policies or procedures;
ii) you are or become excluded from participating in any gambling services by any person;
iii) you may not be gambling responsibly;
iv) you misuse your membership or use the membership of another person;
v) you behave in a manner which The MVRC (in its absolute discretion) considers to be dishonest, offensive, disruptive, intimidating, illegal and/or improper; or
vi) for operational reasons in its absolute discretion;
vii) you are subject to a self-exclusion order, venue exclusion order, regulator-imposed exclusion, or any other lawful restriction relating to gambling activities; or
viii)suspension or termination is reasonably required to enable The Club, MVRC or The Rex Hotel to comply with responsible gambling obligations or applicable gaming legislation.
You will be notified if your membership or marketing subscription is terminated and provided with any applicable refunds as required by law.
Suspension by The MVRC
The Club may suspend your membership or marketing subscriptions to investigate your membership if The Club becomes aware or reasonably believes that your membership or the benefits have been misused by you or by a third party or have been subject to unauthorised use.
The MVRC may suspend your membership or marketing communications subscription if these T&Cs are breached or for operational reasons at its absolute discretion.
7) Liability and Disclaimers
To the extent permitted by law:
a) The Moonee Valley Racing Club, and their related entities exclude all liability (including liability in negligence) for any claim, personal injury, death, loss, damage (including loss of opportunity), cost or expense, whether direct, indirect, special or consequential, suffered, incurred or sustained by you, arising in any way out of your membership of The Club or the marketing communications sent by The Club or by us, including but not limited to, arising out of the following:
i. any theft, unauthorised access or third-party interference;
ii. any participation in any promotions or activities advised via the marketing communications.
b) You release and indemnify The Club and us and each of its officials, employees, representatives, agents and sponsors of The Club and us against any claim, loss, damage, liability, cost and expense that may be incurred or sustained by The Club or by us or our officials, employees, representatives, agents and sponsors arising as a result of or in connection with your membership or marketing subscription except to the extent that the relevant loss, damage or injury was caused or contributed to by the gross negligence or wilful misconduct of The Club or us.
c) We, The Club and our related entities and our officials, employees, representatives, agents and sponsors take no responsibility for late, lost or misdirected mail or marketing communication.
d) We, The Club and our related entities and our officials, employees, representatives, agents and sponsors take no responsibility for any damage or technical issues that may cause damage to any computer or other technology related to or used in connection with The Club or your membership.
e) Marketing communications are provided “as-is.” We do not guarantee the availability or accuracy of promotional offers or events.
8) Changes to These Terms and Conditions
The Club reserves the right to amend these T&Cs at any time.
Members and subscribers will be notified of changes via email and on The Club website. Continued use of services constitutes acceptance of the updated T&Cs.
9) Governing Law
These T&Cs are governed by the laws of the State of Victoria, Australia and you agree to submit to the exclusive jurisdiction of the courts of Victoria.
10) Notices
a) Any notice, communication or other document required or permitted to be given under these T&Cs may be provided by email to the last email address notified by the recipient or by publication on The Club's website. Such communication will satisfy any requirement for a notice or other communication to be in writing.
b) An email sent by The Club to your most recently notified email address will be deemed to have been received on the next Business Day after it is sent, unless the sender receives an automated notification that the email was not successfully delivered.
c) An email sent by you to The Club will be deemed to have been received on the next Business Day after it is received by The Club's email server.
d) It is your responsibility to ensure that your contact details, including your email address, remain current and accurate. The Club is not responsible for any loss, damage or inconvenience arising from your failure to maintain up-to-date contact details.
